Why this matters in 2026
The European Accessibility Act has applied since 28 June 2025, and enforcement
moved from guidance to action during 2026.
The first EAA lawsuits were filed in France in November 2025; other member
states have since begun monitoring programmes.
Penalties run from €60,000 in Ireland to roughly €900,000 in Sweden, and can
extend to removal of a service from the market.
Procurement teams increasingly ask suppliers for written proof of EN 301 549
conformance before signing.
What we will not tell you. No scanner can certify compliance,
and any vendor promising automatic fixes is overselling — in 2025 the US FTC fined one
overlay vendor $1M for exactly that claim. Automated testing catches roughly a third of
EN 301 549 failures. We report that third precisely, name the clause, and mark the rest
as needing human review.
